Living in the United States is the dream of many families who are seeking a better life quality and economic stability. However, it is known that obtaining legal residence is not an easy task, so it is essential to have immigration legal advice to achieve this goal.

At FLIPEX MIAMI we work with a prestigious and experienced law firm specialized in immigration matters whose main objective is to help you achieve your dream of living in the USA by proposing 3 alternatives:

VISA E-2:

Create your own business and live in the United States .

The E-2 visa allows the applicant, spouse, and unmarried children under the age of 21 to reside legally in the United States through an investment. It is a very popular tool for investors from Latin American countries such as Mexico, Argentina, Chile and Colombia who wish to settle in the USA. It has a maximum duration of 5 years with unlimited renewals, which allows you to reside in the United States indefinitely while the business remains operational.

VISA E-2 requirements:

Investment must generate added value.
The amount of the investment must be substantial for the type of business and industry chosen
Operational control of the business (the applicant must have at least 50% of the share capital).
Generate direct or indirect employment for at least 2 people.
Nationality of the investor (See beneficiary countries HERE)

VISA E-2 advantages:

The E-2 visa enables the investor to manage and develop the business while the spouse acquires a work permit that allows them to work under an employement contract and the possibility to attend school for those having children under 21. The investor and the spouse can remain in the country indefinitely as the business continues operating.

A great advantage of the E-2 visa is that it does not oblige the applicant to reside a minimum of days per year in the United States, so the investor can apply for it, live in another country and enter the USA at any time.

At FLIPEX MIAMI we recommend Fix & Flip  as an excellent investment for E-2 visa applicants since it does not require being present in the daily operation of the business or having extensive experience in the real estate or construction sector.

VISA EB-5:

The fastest and most efficient way to obtain residence in the United States.

The main benefit of the EB-5 visa is obtaining the permanent residence better known as the Green Card. The approval process by the USCIS (US Citizenship & Immigration Services) is approximately 18 to 24 months. In addition, it is the previous step to be followed in order to process American citizenship .

VISA EB-5 requirements:

Invest $ 900 thousand dollars in an EB-5 project through a regional investment fund in a low economic activity area called TEA (Targeted Employment Area).
Invest $ 1.8 million dollars in your own project in an area of high economic activity.
Demonstrate the origin and source of funds.
Directly employ at least 10 American citizens or residents.
Reside in the United States a minimum of 181 days per year.
The initial investment must be kept for at least 5 years, then the investor can recover the capital.

VISA EB-5 advantages:

Applicant, spouse and unmarried children under 21 obtain the Green Card.
The funds to apply for an EB-5 VISA do not necessarily have to be deposited in a bank account in the USA, they can be transferred from abroad.
In projects promoted by regional investment funds, the 10 employees are assigned through a methodology established by USCIS.

VISA L-1 :

The smartest alternative for  companies,  executives  and managers.

The L-1 visa allows companies established in the United States or wanting to be established, to transfer an employee to the USA to serve as an executive or manager with the objective of developing the company and / or its business units.

It is very common that Latin American companies, especially Brazil or Europe arrive in the United States by transferring one of their owners or executives through the L-1 visa.

VISA L-1 requirements:

The company must have existed for at least 3 years in the applicant’s country of origin.
The employee must have worked in the company for at least 1 year continuously within the last 3 years.
The company must maintain the same name in the USA as in the country of origin.
The transferred employee must hold an executive or management position or demonstrate specialized knowledge within the company.
The investment made to open the subsidiary in the United States must be substantial with the industry to which the company belongs.
It is granted firstly for one year and then it is renewed every 2 years with a maximum of 7 years.
It is considered a double intention visa because it allows the L-1 visa to be maintained while it can be applied to a permanent residence or green card.

The L-1 visa is another path to the long-awaited Green Card or permanent residence, since after a year of work in the United States, executives, managers or specialized employees can be sponsored by their employers and apply for permanent residence.
